Nintendo has initiated legal action against the accessory manufacturer Genki, alleging trademark infringement following Genki's release of renders depicting a "Nintendo Switch 2" mockup several months before Nintendo officially unveiled its new console. The controversy surrounding Genki's actions erupted during CES 2025 in January, when Nintendo's legal team reportedly visited Genki. Despite this, Genki maintained it had not signed a non-disclosure agreement with Nintendo, thus asserting no wrongdoing.
Genki showcased the Switch 2 mockup, which debuted three months prior to Nintendo's formal unveiling, claiming it was based on a genuine Switch 2 system they had seen and used to develop their accessories. However, court documents obtained by IGN reveal Nintendo's accusations that Genki engaged in a "strategic campaign" to exploit public interest in the upcoming console, charging them with trademark infringement, unfair competition, and false advertising.
Nintendo's legal filings assert that Genki boasted about gaining unauthorized early access to the unreleased console, allowing guests to interact with the mockups. They further argue that Genki's claims of compatibility were misleading and could only be substantiated through illegal access to the Switch 2. The documents highlight that Genki initially claimed access to a real console but later contradicted this, yet continued to assert that their accessories would be compatible with the Switch 2 upon its release.

Nintendo also accuses Genki of infringing on its trademarks through their advertising and competing directly with Nintendo's and its licensees' legitimate marketing efforts. Additionally, Nintendo takes issue with a tweet from Genki's CEO, Edward Tsai, and a website pop-up, both hinting at unauthorized access to Nintendo's headquarters.
In response, Nintendo is seeking an injunction to prevent Genki from using the "Nintendo Switch" trademark in its marketing, the destruction of any products or marketing materials referencing Nintendo's branding, and unspecified damages, which they request to be tripled.
Over the weekend, Genki issued a statement on social media acknowledging the lawsuit and their serious approach to it, while working with legal counsel. Genki emphasized their commitment to creating innovative gaming accessories and their pride in their work, while preparing to fulfill orders and showcase new products at PAX East. They thanked their supporters and promised more updates, focusing on continuing to build gear for gamers.
